Since the petitioner is confined post his conviction in Morshi Open Prison, we are inclined to take recourse to the proviso to Rule 6 of the Prisons (Bombay Furlough and Parole) Rules, 1959 which provides that the Sanctioning Authority may dispense with the requirement of execution of such bond by relatives of prisoners.

The fact that the petitioner is confined in open prison is borne out of the record.

That being so, we direct the respondent to release the petitioner on his personal bond. The rest of the conditions imposed directing to release the petitioner shall be set aside.
