2 appln11.14 The application is adjourned several time since 19th September, 2014. On 29th February, 2016 matter was adjourned for 7th March, 2016 on request made on behalf of the applicant and again on 7th March, 2016 matter was adjourned on request made on behalf of the applicant. The learned advocate who has mentioned on behalf of the applicant is not willing to make submissions. Heard Shri R.K. Tiwari, advocate for the non-applicant no.2 and Shri K.R. Lule, A.P.P. for the non-applicant no.1. The application is filed under Section 439(2) of the Code of Criminal Procedure praying that the order passed by the learned Additional Sessions Judge on 19th November, 2013 granting pre-arrest bail to the non-applicant no.2 be set aside and the pre-arrest bail granted to the non-applicant no.2 be cancelled.
Earlier, the applicant was the President and Trustee of the Trust. The non-applicant no.2 was also Trustee of the Trust. Considering the nature of dispute and the fact that the non-applicant no.2 is on bail for about 29 months and there is no complaint against him that he has misused the liberty, I am not inclined to grant the prayer made in the application.
