Misc. Civil Application 958/2024 is filed by the applicant/husband and another Misc. Civil Application No.135/2024 is filed by the non-applicant/wife. Both the applications are filed to transfer the matter which is pending in Pune Court and Nagpur Court. The applicant/husband is praying to transfer the matter from Court at Nagpur to Court at Pune as he is staying there with his five years old daughter and mother. His mother is bedridden. There is nobody to take care of his daughter. He has undergone the hip replacement surgery in 2022, therefore, doctor restricted his travelling activity. Hence, he has filed the application to transfer the matter which is filed by the non-applicant vide Petition (A) No.1566/2023 for restitution of conjugal right pending before the Family Court -1, Nagpur to the Family Court at Pune.

He has stated that non-applicant can appear on V.C. and he is ready to give the travel expenses to attend the Court at Pune.

The learned Counsel for the non-applicant has stated that the marriage was performed in Nagpur. The native place of non-applicant in MCA No.958/2024 is Nagpur. They stayed lastly at Pune and, therefore, he has filed petition A-2119/2023 at Pune, which is pending before the Family Court at Pune. 4.

The non-applicant is teacher by profession and it is not possible for her to travel and attend the Court at Pune and in M.C.A. No.135/2024, she has filed the application to transfer the petition A-2119/2023, pending before the Family Court at Pune to the Family Court at Nagpur.

Heard both the learned Counsel for the parties. 6.

Considering the applicant's position in M.C.A. No.958/2024, the child is staying with him, the medical problems faced by the applicant, it is convenient to nonapplicant in said matter to attend the Court at Pune and for that the applicant is ready to give the traveling charges. Hence, I pass the following order :

The Misc. Civil Application No.958/2024 is allowed. 8.

The Misc. Civil Application No.135/2024 is rejected. 9.

The petition bearing No. Petition (A) No.1566/2023 pending before the Family Court -1, Nagpur is hereby transferred to the Family Court at Pune.
