Dated : 23 rd March, 2015 The application rejected by the Trial Court was filed under Order VII, Rule 11 of the Civil Procedure Code. I have gone through the contents of the application. The material facts required to be pleaded to make out a case under Order VI, Rule 16 of the Code have not been pleaded. The application cannot be considered to be one under Order VI, Rule 16 of the Code. No interference is called for in the impugned order. The petition is dismissed with liberty to the petitioner to file a separate application under Rule VI, Rule 16 of the Civil Procedure Code to be decided in accordance with law. Judge.
