DATE : 07/04/2022 The present revision challenges the order dated 31.01.2022 passed by the learned Sessions Court, in revision, whereby the order dated 02.09.2021, passed by the learned Chief Judicial Magistrate granting bail has been set aside on the ground that it is cryptic order, dehors of any reason whatsoever.

Considering the order dated 02.09.2021 (page 51), I do not see any reason to differ from the view taken by the learned Sessions Court and it would be open for the applicant to approach the learned Chief Judicial Magistrate afresh by filing a bail application to secure bail, which shall be decided on its own merit, upon consideration of the entire material in the charge-sheet. However, since the liberty of the applicant has been

(2) 41.revn.47.2022 continued by the learned Sessions Court by the order dated 31.01.2022 passed below Exh.17, which has been further continued by this Court by order dated 21.02.2022, the said protection shall be continued for a further period of three weeks from today, by which time, the learned Chief Judicial Magistrate shall decide the application for bail filed by the applicant on its own merits.

The application is disposed of in the above terms.
