The learned Counsel for the respondent no.3/Acquiring Body submits that the present application has become infructuous as the Acquiring Body already deposited the amount of compensation in another proceedings i.e. First Appeal No.635/2005. Even if, such amount is not deposited then the Appellant/Claimant may take out appropriate proceeding for recovery, as the appeals are already disposed of.
