The applicant came to be arrested 21.01.2025 in connection with Crime No.18/2025 registered with Police Station, Ranapratap Nagar, Nagpur, for the offences punishable under Sections 275, 274, 223 and 123 of the Bhartiya Nyay Sanhita, 2023.

Heard learned counsel for the applicant who submitted that crime is registered on the basis of the report lodged by informant HC Nitin Devendra Wasnik on an allegation that present applicant was found in possession of contraband scented tobacco worth of Rs.45,000/-. Now the investigation is already completed. Charge-sheet is filed. Further incarceration of the present applicant is not required. In view of that he be released on bail.

Learned APP strongly opposed the application on the ground that there are similar types of offences registered against the present applicant. 5.
On hearing of the both the sides and on perusal of investigation papers, it reveals that there are criminal antecedents registered against the present applicant. But that itself is not sufficient to reject the application of present applicant. Admittedly now the investigation is completed and charge-sheet is filed. Further custodial interrogation of the present applicant is not required. In view of that the application deserves to be allowed. The applicant be released on bail. Accordingly I proceed to pass following order:
ORDER
(i) The application is allowed.
(ii) The applicant Dinesh s/o Sadhuram Krishnani, shall be released on bail in Crime No.18 of 2025, registered with Police Station Ranapratap Nagar District: Nagpur for the offences punishable under Sections 275, 274, 223 and 123 of the Bhartiya Nyay Sanhita, 2023 on executing PR bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one solvent surety in the like amount.
(iii) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the present case.
(3) 43 ba 175.25.odt. (iv) The applicant shall attend the proceeding before the trial Court without seeking any exemption unless there are exceptional circumstances.
(iv) The applicant shall not indulge himself in similar types of the offence.
