In the present matter, the respondent has filed an application seeking modification of the settlement terms arrived at between the parties before the National Lok Adalat. As per the order of the National Lok Adalat dated 22.03.2025, it was observed that, in view of the settlement between the parties, the appeal stands disposed of.

Subsequently, the learned counsel for the non-applicant has filed the present application seeking modification in Point Nos. 2 and 3 of the settlement terms dated 22.03.2025. It is submitted that in Point No. 2, the amount mentioned as "compensation of Rs. 65,62,108/-" requires correction, as the correct and undisputed amount due and payable to the respondent is Rs. 63,62,588/-.

Further, in Point No. 3, it was stated that the said amount shall be deposited by the appellant, NHAI, before this Court and subsequently transferred to the Court of the Civil Judge, Senior Division, Akola, in Execution Application bearing ARD No. 228 of 2023. The learned counsel for the respondent has submitted that the respondent may be permitted to withdraw the compensation amount deposited before this Court. The learned counsel for the NHAI has expressed no objection to the said modification.

In view of the submissions made, the application seeking modification of the order dated 22.03.2025 is allowed. The order stands modified to the extent indicated above.

The application is accordingly disposed of.
