Heard learned counsel for the applicant. None appeared on behalf of non-applicant despite service of notice.

(2) This is an application under Section 24 of the Code of Civil Procedure for transfer of Petition No.A/133/2021 from Family Court-2, Pune to Family Court, Nagpur.

(3) It is stated in the application that the distance between Nagpur to Pune is more than 900 Kms and requires her to travel more than 18 hours. It is stated that the father of the applicant died on 25.09.2020 and therefore it is difficult for her to travel such a long distance from Nagpur to Pune. The applicant has filed proceedings at Nagpur under the Domestic Violence Act and the non-applicant is attending the said proceeding at Nagpur.

38 mca156.21.odt (4) In spite of the service of notice to the nonapplicant, he has chosen not to appear before this Court. His conduct reflects that he has no objection if the proceedings are transferred to Family Court at Nagpur.

(5) In this view of the matter, the application is allowed in terms of prayer clause (i).

(6) The application stands disposed of.
