Heard learned counsel Shri G.G. Bade for the applicant and learned Additional Public Prosecutor Shri S.S. Doifode for non-applicant No.7/State. Nobody appears for other non-applicants. The notices, in the matter, have yet not been issued. On 12.7.2016 this Court has asked learned Additional Public Prosecutor to obtain instructions from the concerned Public Prosecutor regarding the stage of the trial.
From arguments of learned counsel Shri G.G. Bade for the applicant it appears that process was issued. The question is, whether charge has been framed or not. It appears that the order issuing process was questioned before the Sessions Court and the interim orders were operating therein. After vacation of .....2/-
those interim orders, matter has to begin again before Court No.2, J..M.F.C., Nagpur.
In this situation, without going into merits of the controversy and as we find the criminal complaint is filed since 2007, we grant the present applicant leave to move appropriate application before the Trial Court only for expeditious time bound disposal of that complaint. If such application is moved by the applicant, within a period of one week from today, the Trial Court shall decide it on its own merit, within a period of four weeks.
As the matter is about nine years old, it is apparent that the Trial Court shall give matter its due urgency.
With these directions, we dispose of the criminal application. No costs.
