Present application is filed for condonation of delay in filing application for restoration of Family Court Appeal No.324/2014. There is a delay of 1755 days in filing application for restoration of the Family Court Appeal. 2.
It is submitted that the earlier counsel has not informed to the appellant about dismissal of the matter. 3.
The learned Counsel for the respondent submitted that during this period from dismissal to filing of this application for delay condonation, the respondent has performed second marriage. However, we think it
2 CAO No.348.2024 appropriate, it would be settled in mediation if the matter would be referred to the Mediator.

As such, though there is delay, it needs to be condoned for the reasons mentioned in the para Nos.3 and 4.

Accordingly, the application is allowed. The delay of 1755 days in filing restoration application is hereby condoned. The Registry is directed to register the Misc. Civil Application (St.) No. 2861/2024.

The civil application stands disposed of.
MISC. CIVIL APPLICATION (ST.) NO. 2861 OF 2024 1.
Present application is filed for restoration of Family Court Appeal No.324/2014. For the reasons mentioned above, the Misc. Civil Application (St.) No. 2861/2024 is allowed and disposed of.

The Registry is directed to register the Family Court Appeal on its original number.

After restoration, the Family Court Appeal be referred for mediation.
4.
The learned Co-ordinator, High Court Legal Services SubCommittee, Nagpur to do the needful. 5.
It is informed that the respondent is in jail therefore, necessary arrangement of his appearance through Video
3 CAO No.348.2024 Conference be made by the Co-ordinator, High Court Legal Services Sub-Committee, Nagpur.

The parties to appear before the learned Mediator on 15.12.2025.
