Heard Mr. S. V. Sirpurkar, learned counsel for the appellant and Mr. H. D. Dubey, learned APP for the respondent.

This is an application for suspension of sentence and grant of bail.

It is not in dispute that applicant/accused is on bail during the trial and has not jumped the bail conditions. The maximum punishment awarded is five years and the applicant/accused is granted set off of eight months.

Considering the reasons for conviction, case for suspension of sentence and grant of bail is made out. 6.
In view of above, in my opinion, applicant/accused deserves to be released on bail. Sentence is suspended.

The applicant/accused is ordered to be released on bail on same terms of which he was released on the bail by Trial Court during the pendency of the trial. The application stands allowed.

This order be communicated to the counsel appearing for the parties, either on the email address or on WhatsApp or by such other mode, as is permissible in law.
