Learned counsel for the applicant has submitted that the applicant is the original defendant No.12, and the suit is filed in the year 2005 against him and others for partition, separate possession and perpetual injunction. Learned counsel for the applicant has submitted that applicant is unable to attend the said proceedings, and therefore, the Regular Civil Suit No. 25/2005 pending before the learned Civil Judge, Junior Division, Anjangaon Surji, Dist. Amravati be transferred to the Court of Civil Judge, Junior Division, Akola.

Considering the submissions of the learned counsel for the applicant, I am of the view that notices is not required to be issued in this matter. Hence, Misc. Civil Application is filed by the applicant is dismissed at the admission stage. No order as to costs.
