Heard Mr. M. V. Rai, Advocate for applicant and Mr. N. R. Rode, A.P.P. for non applicant-State. Perused the reply. The reply shows that as on today, 16 offences are pending against the present applicant. The offences are of the years 2015, 2016 and 2017. That shows that the applicant has formed a habit of committing offences as soon as he is released on bail.

In the present case, the investigation is still in progress. Therefore, looking to the track record, in my view, this is not the case wherein discretion should be exercised in favour of the applicant.

Hence, the application is dismissed.
