Learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to file appeal under Section 39 (3) of the Maharashtra Village Panchayats Act, 1959 against the order impugned.

If such appeal is filed within a period of two weeks from today, it shall be treated as filed within limitation and the appellate authority shall endeavour to decide it within a period of three months from the date of filing of such appeal. 3.

The writ petition is disposed of in the aforesaid terms. No order as to costs.
