By preferring this application, the applicant seeking bail as he came to be arrested on 04/01/2025 in connection with Crime No.2/2025 registered with Police Station Railway Mulchera, District Gadchiroli for the offence punishable under Sections 65(a) and 98 of the Maharashtra Prohibition Act.

Learned Counsel for the applicant submitted that the present applicant allegedly found transporting the liquor worth more than Rs.14.00 lakhs and his vehicle was intercepted and the contraband liquor is seized from his possession. He submitted that now, the investigation is completed and charge-sheet is filed, his incarceration is not required. The material is also seized. In view of that, he be released on bail. He submitted that his bail application is rejected merely on the ground, that there is criminal antecedents.

Learned APP strongly opposed the application on the ground that there are 14 cases registered against the present applicant of a similar nature. In view of that, the application deserves to be rejected.

I have heard learned Counsel for both the sides. On considering the entire investigation papers there is no dispute as to the fact that liquor worth of Rs.14.00 lakhs was seized from the possession of the present applicant. He was caught when transporting the said contraband. As far as further incarceration of the applicant is concerned which is not required, as now investigation is already completed and charge-sheet is filed. Now, it is settled that mere criminal antecedents are no sufficient to reject the bail application of the present applicant. 6.
Considering the nature of the investigation and considering the fact that the investigation is completed, his further incarceration is not required. Accordingly, I proceed to pass the following order: (i) The application is allowed.
(ii) The applicant - Manoj Jagdish Mujumdar in connection with Crime No.2/2025 registered with Police Station Railway Mulchera, District Gadchiroli for the offence punishable under Sections 65(a) and 98 of the Maharashtra Prohibition Act, be released on bail on executing a P.R.Bond in
the sum of Rs.1,00,000/- with one solvent surety, in the like amount.
(iii) The applicant shall not directly or indirectly make any inducement and threat or promise to any person acquainted with the facts of the present case either personally or by way of electronic media.
(iv) The applicant shall attend the proceedings before the trial Court without seeking any exemption unless there are exceptional circumstances.
(v) The applicant shall not indulge himself in similar type of the offence.

The contravention of any of the condition imposed by this Court would lead to the cancellation of bail.

The application is disposed of.
