DATE : 18.2.2016 Heard Shri A.S. Tiwari, advocate for the applicant and Ms. N.P. Mehta, A.P.P. for the non-applicant. The applicant is seeking pre-arrest bail apprehending arrest in crime registered against him for the offence punishable under Section 307, 141, 143, 147, 148 and 149 of the Indian Penal Code.
The applicant had earlier filed Criminal Application (ABA) No.494/2015 seeking pre-arrest bail which is rejected by this Court by the order dated 1st December, 2015. This Court
2 aba88.16 considered the relevant paragraph of the reply filed by the non-applicant and observed that prima facie it appears that the applicant is directly involved in the commission of crime. This Court further observed that the applicant had earlier been involved in serious offences against human body as well under the Arms Act. The applicant has not stated in the application that he was not involved in any other crime, earlier. In view of the above observations made by this Court while rejecting the Criminal Application (ABA) No.494/2015, I am not inclined to consider the prayer made in the present application. The application is rejected. No orders as to costs.
