The learned counsel for the petitioner submits that in present petition the order dated 10.01.2024 passed by respondent no.2 i.e. Banking Ombudsman is under challenge as in complaint No.-N202324021016301 it is held that complaint is not maintainable as the suit filed by Bank of Maharashtra is pending and matter is subjudice. It is mentioned that the said proceeding is withdrawn by the Bank of Maharashtra itself and therefore, there is no impediment to approach afresh before the Banking Ombudsman. Accordingly, the petitioner seeks permission to withdraw the petition with liberty to approach the Banking Ombudsman afresh.

Accordingly, the petition dismissed as withdrawn with liberty as prayed.
