DATE : 10.4.2015 The Labour Court had allowed the complaint filed by the petitioner and directed reinstatement with continuity and back wages. The revision filed by the respondent is allowed, the impugned order passed by the Labour Court is modified and instead of reinstatement, the Industrial Court has granted compensation of Rs.50,000/-. The respondent has deposited the amount of Rs.50,000/- with the Industrial Court.

The petitioner has filed the writ petition challenging the order passed by the Industrial Court and prayed that the order passed by the

2 caw373.15 Labour Court be restored. The respondent has not challenged the order passed by the Industrial Court granting compensation of Rs.50,000/- to the petitioner.

In these circumstances, the petitioner is entitled for the amount of Rs.50,000/- subject to his rights subjudiced in this writ petition. The petitioner is permitted to withdraw the amount of Rs.50,000/- deposited by the respondent before the Industrial Court, along with interest, if any. The civil application is allowed in the above terms. JUDGE Tambaskar.
