DATE : 27.02.2017 CAF No. 775/2017 The claimants seek permission to withdraw the balance amount of compensation deposited by the appellant. It is stated that by the order dated 12th April, 2013, an amount of Rs.1,00,000/- ( Rs.One lac.) was permitted to be withdrawn as the claimants were not in a position to furnish any security. It is stated that now, the claimants/applicants can furnish security. The application is opposed by the learned counsel for the appellant by relying upon the defense taken before the claims tribunal.

Perused the impugned judgment. Considering the findings recorded therein, the claimants are permitted to withdraw an amount of Rs.1,00,000/-( Rs. One lac) subject furnishing solvent security/surety to the satisfaction to the Registrar (Judicial). Remaining amount be invested in Fixed Deposit.
