C.A.F. NO.44/2017 Considering the facts of the case, it is directed that there shall be interim order in terms of prayer clause (i) of the civil application, however, on condition that the appellant deposits the amount as per impugned award with the Registry of this Court till 16th April, 2018. If the amount is deposited, it should not be given to the respondents / claimants and shall be kept in fixed deposit in the nationalized bank, till disposal of the appeal.

If the amount is not deposited within

2 fa15.17 stipulated time this interim order shall cease to operate from 17th April, 2018 and the respondents will be at liberty to proceed with the execution. The civil application is disposed in the above terms. No costs. JUDGE Tambaskar.
