By this application, the applicant is seeking the condonation of 803 days in preferring the restoration application.

According to the applicant, this court by order dated 17.4.2017 granted six months time to file the private paper book, however, within that prescribed period, appellant failed to file the private paper book and, therefore, the Registrar of this court has rejected the appeal. The appellant solemnly made statement that within a period of two weeks the private paper book will be filed in the matter. The applicant also agrees that in case the private paper book is not filed within a period of two weeks, the order of this court will be recalled. Hence, by accepting the statement, the delay of 803 days is hereby condoned and order of dismissal of appeal is hereby quashed and set aside.

The office is directed to restore First Appeal No.1110/2016 on its original position.
