Heard learned counsel for the applicant.
It is submitted that during the lifetime of the petitioner, the petitioner has executed sale deed in favour of the present applicant. Necessary mutation is also recorded in the revenue record. It is submitted that as the controversy relates to the suit property which is now purchased by the applicant and the applicant is now willing to step into the shoes of the original petitioner, the applicant be permitted to substitute himself in place of the original petitioner.
The learned counsel appearing for the respondent nos. 2 and 3 raises no objection.
The application is allowed in view of the above in terms of its prayer.
