CORAM : SMT. VASANTI A NAIK AND MRS. SWAPNA JOSHI, JJ.

DATE : APRIL 20 , 2018.

The only prayer made by the petitioner in the instant petition against the State Government is for a direction to install C.C.T.V. cameras in all the prisons in the State of Maharashtra and capture the entire jail premises and retain the C.C.T.V. footage so as to prevent physical assault and ill-treatment at the hands of the jail authority.

The respondent no.2 has tendered the affidavit-in-reply in the Court today. It is stated in the affidavit-in-reply that in almost all the prisons in the State of Maharashtra, the C.C.T.V. cameras are installed and in some prisons that are bigger, more than 100 C.C.T.V. cameras are installed. It is stated that in Nagpur Central Jail, with which the petitioner is concerned, 104 C.C.T.V. cameras are installed. It is stated that in Nasik Road Central Prison, 94 C.C.T.V. cameras are installed. It is stated that these C.C.T.V. cameras cover the male yard, female yard, common area, perimeter and the required places inside and outside the prison. It is stated that the C.C.T.V. cameras are already installed in almost all the prisons in the State of Maharashtra. It is stated that the prisons in which the cameras are not installed, they will be installed within a short time. It is stated that the C.C.T.V. footage is preserved for a considerable time.

CRI.WP131-18 In view of the statements made in the affidavit-in-reply filed on behalf of the respondent no.2, the grievance of the petitioner should stand redressed. Hence, by accepting the statements made on behalf of the respondents in the affidavit-inreply, which would be binding on the respondents, we dispose of the writ petition with no order as to costs.
