For the reasons stated in para 3, I am satisfied that there is no intentional delay in filing the First Appeal. As such, the application is allowed. Delay in filing First Appeal is hereby condoned.

Accordingly, the application stands disposed of. CIVIL APPLICATION (CAF) NO. 911 OF 2018 Issue notice to the respondents, returnable within three weeks.

The present application is filed for grant of stay, however, no amount is deposited in this Court. The appellant is directed to deposit the entire decreetal amount within a period of eight weeks from passing of this order.
