This application is for suspension of substantive sentence imposed upon applicant and for bail contending that applicant was on bail pending Trial .....2/-
and his sentence was suspended, pending appeal. It appears that applicant is convicted for the offence punishable under Section 304(A) of the Indian Penal Code and is sentenced to suffer simple imprisonment for one year and to pay a fine of Rs.2,000/-, in default, to suffer simple imprisonment for one month.
Appeal preferred against said conviction is dismissed.
Considering fact that applicant was on bail and his sentence was suspended, pending appeal, and since applicant is also convicted for the short sentence, application is allowed as per order below.
Applicant shall be released on bail on his executing P.R. Bond in the sum of Rs.25,000/- with one surety in the like amount.
While on bail, applicant shall mark his presence with Police Station Adyal, Tahsil Paoni, District Bhandara quarterly on the first day of each such month, pending revision.
Application stands disposed of accordingly.
