Although the petitioner had challenged the impugned judgment directing it to pay additional penalty and notice was issued in the present writ petition, it is stated on behalf of the petitioner that to put an end to the litigation, the petitioner agreed to pay such amount towards additional penalty of Rs.2,88,000/-. An application has been placed on record stating that the petitioner intends to pay the said amount and consequential directions be given to respondent No.2 to release the concerned document i.e. original agreement to sale dated 02/07/2018. 3.

The learned counsel appearing for the petitioner submits that today the petitioner has indeed paid the aforesaid

2 wp 966.20.odt amount towards additional penalty and that, therefore, consequential directions to respondent No.2 may be passed by this Court. The learned AGP submits that document showing deposit of the additional penalty is not on record and, therefore, a statement in that behalf cannot be made by the learned AGP. 4.

In these circumstances, the present writ petition is disposed of recording the statement made on behalf of the petitioner that the aforesaid amount towards additional penalty has been deposited today. Respondent No.2 shall verify the said statement made on behalf of the petitioner and if it is found that the statement is correct and the amount has been indeed deposited, the respondent No.2 shall release the aforesaid document to the petitioner within a period of 10 days from today. 5.

Writ petition is disposed of.

It is pointed out by Advocate Smt. Meghna Munshi that her name is wrongly mentioned in the petition. Office is directed to delete her name from the record.
