Shri Dharmadhikari, learned Senior Advocate makes a request for withdrawal of the present petition with liberty to avail alternate remedy. It is further stated that the interim protection granted by this Court may be continued till the disposal of the appeal and the appeal may be made time bound.

Shri Nitin V. Gangal, learned counsel appearing for the State along with learned A.G.P. have no objection as regards withdrawal of the present writ petition, however, have objection to continue the interim relief. Considering the fact that alternate remedy is available and C.L.Dhakate

1.wp.1023.22.odt the petitioner wants to avail the same, permission is granted to withdraw the present petition.

As far as interim protection is concerned, the same is operating from last more than fifteen months and therefore, I am of the opinion that, no objection will be caused to any of the parties if such protection is continued till the appeal is decided. Accordingly, the writ petition is disposed of as withdrawn with liberty as prayed for. 5.

If the appeal is filed within two weeks from today, the interim protection granted by this Court vide order dated 09.03.2022, shall continue till the decision of the appeal.

The Appellate Authority is directed to decide the appeal within eight weeks from the date of filing of the appeal.
