Criminal Application (APPA) No.134/2021 This application filed by the applicantappellant for suspension of sentence passed against the applicant by the learned Additional Sessions Judge, Achalpur in Special Atrocity Case No.4/2010, thereby convicting the appellant under Section 417 of the Indian Penal Code and sentencing him to suffer rigorous imprisonment for 6 months and to pay a fine of Rs.10,000/-, in default of payment of fine, with a default clause.
2 apeal101.21 The learned Trial Court has already suspended the sentence under Section 389 of the Code of Criminal Procedure. In that view, the substantive sentence of imprisonment passed against the applicant is hereby suspended. The applicant shall be released on same bail and conditions as were imposed by the learned Trial Court. After release, the applicant shall deposit the compensation amount of Rs.20,000/- in the Trial Court, within a period of eight weeks from the date of his release, failing which, the bail granted to the applicant shall be liable to be cancelled.
