DATED : 20.02.2020 The applicant is charge-sheeted for offence punishable under Sections 363, 366, 366-A, 370, 376(2) (k) (n) read with Section 34 of the Indian Penal Code and Sections 4 and 6 of the Protection of Children from Sexual Offences Act, 2012.

The role which is attributed to the applicant is that she took the minor victim to Gujarat and for a consideration arranged her marriage with co-accused Goswami. The role which is attributed is not restricted to arranging the marriage. The witness who accompanied the applicant and the minor to Gujarat, where the marriage of the minor was solemnized, has categorically stated that the applicant was paid Rs.30,000/- . The material on record shows that part of the amount is recovered from the applicant, pursuant to memorandum under Section 27 of the Indian Evidence Act.

There is ample material on record to connect the applicant with the crime. The minor professes Muslim faith. She was married to a Hindu. As a fact, the minor was sold. The applicant has played an active role in the human trafficking and sexual exploitation of the minor. 4.

Rather than releasing the applicant on bail, the appropriate course would be to request the learned trial Court to expedite the trial and to make an endeavor to complete the same within six months. If there is no significant progress in the next four months, the applicant is at liberty to approach this Court again for bail. The application is disposed of.
