DATE : 18.3.2016 Heard Shri A.M. Jaltare, advocate for the applicant and Shri R.S. Nayak, A.P.P. for the non-applicant.

The applicant is seeking pre-arrest bail apprehending arrest in crime registered against him for the offence punishable under Section 376(2)(n) and 417 of the Indian Penal Code.

The crime is registered against the applicant on the complaint of victim (aged about 17 years) that on the pretext of marriage the applicant developed physical relationship with her. Considering the nature of accusations against the applicant and the fact that the non-applicant has not been able to show that the custody of applicant is required for further investigation, in my view, the interim order granted by this Court on 12th February, 2016 is required to be confirmed.

Hence, the following order:

(i) In the event of arrest of applicant in the Crime No.102/2015 registered by the non-applicant, the applicant be released on bail on furnishing P.R. bond for Rs.10,000/- (Rs. Ten Thousand Only).

2 aba81.16 (ii) The applicant shall attend the police station Mahagaon, Distt. Yavatmal on being summoned to enable the Investigating Officer to undertake the required investigation.

(iii) The application is allowed in the above terms. CRIMINAL APPLICATION (APPP) NO.196/2016 In view of disposal of main application, this application does not survive and is disposed of accordingly.
