This application under Section 378(4) of the Code of Criminal Procedure is filed by the original complainant seeking leave to file appeal to challenge the judgment passed by the trial Court dismissing the complaint and acquitting the non-applicant / respondent of the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. Considering the facts of the case, I am satisfied that the applicant is entitled for grant of leave to file appeal. The criminal application is allowed accordingly. CRI.APPEAL NO. /2017.
