The petitioner has challenged the order passed by the Family Court restricting the amount of maintenance to Rs.5,000/- per month. According to the petitioner, the Family Court has recorded that the income of the respondent (husband) is about Rs.70,000/- per month and considering the status of the parties, the respondent should have been directed to pay Rs.25,000/- per month towards maintenance pendente lite.

With the assistance of the learned Advocate for the petitioner, I have gone through the documents placed on the record of the petition and the impugned order. In paragraph No.14 of the impugned order, the learned Judge has recorded that the petitioner is paying huge interest on loans taken for purchase of flat and vehicle. After considering all the relevant material and assessing the evidence on record, the learned Judge has
2 wp143.16 concluded that the respondent should pay Rs.5,000/- per month towards maintenance pendente lite, the amount being payable from 05-09-2015 i.e. the date of filing of the application.

I do not find any illegality or perversity in the impugned order. The petition is dismissed.
