DATE : 10/02/2023 The learned APP Mr. Thakre make a categorical statement that the applicant was served with a notice under Section 41-A of Cr.P.C. on 23/12/2022, but he has failed to abide by the said notice.

In the wake of the latest authoritative pronouncement of the Hon'

ble Supreme Court in the case of Satyendra Kumar Antil vs. CBI (2022) 10 SCC 51, when it is made imperative for the Investigating Officer to issue notice under Section 41-A of Cr.P.C. in case where the offence entails punishment of less than seven years, equally the applicant/accused is duty bound to respond to the said notice.

The learned counsel Mr.A.K.Bhangde appearing for the applicant categorically make a statement that within a period of three days from today the applicant will report to the Investigating Officer. The Investigating Officer shall thereafter interrogate him and in case if he desirous to effect his arrest, he shall specifically record reasons to that effect in writing.

Needless to say that if within three days, there is no appearance of the applicant before the Investigating Officer, he is at liberty to effect his arrest.

Application stands disposed of.
