DATED : 04-03-2020 The applicant is in jail since 19-7-2019 in connection with Crime 201/2019 registered with Police Station Murtizapur for offences punishable under Sections 376, 376(2)(n), 376(3), 376-B of the Indian Penal Code read with Sections 3, 4, 6 of the Protection of Children from Sexual Offences Act and Sections 9 and 10 of the Prohibition of Child Marriage Act, 2007. 2.

According to the prosecutrix, she married the applicant on 27-5-2017 when she was 14 years old. The other allegations pertain to the divorce document dated 25-3-2019 between the prosecutrix and the applicant and then the relationship between the applicant and the coaccused Pavan Bardiya. 3.

The allegation against the present applicant is that although he knew that the prosecutrix was under age, he went ahead with the marriage.

The applicant has no criminal antecedent and is not likely to be unavailable for trial.

The application is allowed.

The applicant shall be released on bail on furnishing personal bond of Rs.20,000/- with a solvent surety of like amount.
