DATE : 10/02/2023 The co-accused in the same C.R. was granted protection from arrest, which was confirmed by this Court on 25/01/2023. Considering the said order, as well as the accusations faced by the applicant invoking Sections 409 and 420 along with Section 34 of the IPC, it is imperative on the part of the Investigating Officer to issue notice under Section 41-A of Cr.P.C. to the applicant.

Upon issuance of notice the applicant shall report to the Investigating Officer within a period of three days of its receipt and render his co-operation in the investigation.

2 / 2 03-ABA 90.2023 In case the Investigating Officer arrived at a conclusion that the custodial interrogation of the applicant is necessary. He shall specifically record his reasons to that effect.

Failure on the part of the applicant to report to the Investigating Officer, would confer the liberty upon the Investigating Officer to effect his arrest.
