By this application, the applicant/appellant is seeking condonation of delay in preferring the application for restoration of appeal and restoration of first appeal, which was dismissed due to non removal of office objection. 3.
In view of deposit of entire decreetal amount in the execution proceedings, the appellant/applicant do not want to prosecute the appeal.

The statement is accepted. Present application is hereby allowed and disposed of.

It is informed that entire decreetal amount has been deposited in the Execution proceedings by the Claimant before the Reference Court. Hence, the appellant is not interested to prosecute the present appeal. Therefore, request is made for refund of court fee.
