Heard. Perused the contents of the application. Also perused the judgment of the Motor Accident Claims Tribunal, Nagpur in Claim Petition No.1028 of 2009.

Since the appeal is admitted and questions of fact as well as law would be decided in the appeal, being a first appeal, we permit the applicants to withdraw a sum of Rs.4,50,00,000/- (Rupees Four Crores Fifty Lakhs only) from the amount deposit by the appellant in this Court. The balance amount should be placed in a fixed deposit account of a nationalized bank and if possible in the Reserve Bank of India.

The civil application is allowed in the aforesaid terms and disposed of.
