The only prayer made by the petitioner is for the direction to the respondent No.2-Collector to implement the order of the Hon'ble Minister, dated 31/07/2014 and refund the amount towards the unexcavated quantity of sand.

It is the case of the petitioner that despite the decision of the Hon'ble Minister, dated 31/07/2014 to take appropriate steps in the matter of refunding the amount to the petitioner towards the unexcavated sand, the respondent No.2-Collector has not released the amount in favour of the petitioner till date. Shri Rode, the learned Assistant Government Pleader, states on instructions from the respondent No.2-Collector, Bhandara that the requisite amount would be paid to the petitioner within a period of two months.

By accepting the statement made by the learned Assistant Government Pleader, which would be binding on the respondent No.2Collector, we dispose of the writ petition with no order as to costs. JUDGE JUDGE KHUNTE
