2] When enquired, the learned Counsel for the parties jointly submit that neither the applicant nor the non-applicant has filed the statement of assets and liabilities in terms of the judgment passed by the Hon'ble Supreme Court in the case of Rajnesh Vs. Neha And Another [(2021) 2 SCC 324].
3] The order impugned therefore will have to be set aside with a direction to the Family Court to consider the same afresh in the light of the guidelines issued by the Hon'
ble Supreme Court in the case of Rajnesh Vs. Neha And Another (supra).
4] Accordingly, the order dated 16/11/2022 passed by the Family Court, Yavatmal in Petition No. E26/2020 is hereby quashed and set aside. The petition is
37-REVN-33-2023 restored on the file of the Family Court, Yavatmal with a direction to decide the same afresh in terms of the judgment of the Hon'
ble Supreme Court in the case of Rajnesh Vs. Neha And Another (supra).
5] The parties shall appear before the Family Court, Yavatmal on 20/12/2023 and on the same day shall file the statement of assets and liabilities failing which the Family Court may pass appropriate order in this regard. In the meantime, the husband shall continue to pay the amount of maintenance as directed by the Family Court, Yavatmal until it is modified by it.
6] The Criminal Applications are accordingly stand disposed of.
