Shri Khubalkar, the learned Assistant Government Pleader appearing on behalf of the respondent nos.1 and 2, states that the writ petition would not be tenable as there is an alternate remedy available under the provisions of the Maharashtra Cooperative Societies Act, 1960 for seeking the relief sought by the instant petition.

In view of the objection raised on behalf of the respondents, the learned counsel for the petitioners seeks permission to withdraw the writ petition with a view to avail the alternate remedy. The learned counsel states that the points raised in the petition may be kept open.

In view of the aforesaid, the writ petition stands disposed of as withdrawn.
