Date : 11 th January, 2017 Shri Dharaskar, the learned counsel for the appellant, submits that this second appeal is not maintainable, as the proceedings before the Courts below arise out of a suit for eviction and possession under the Maharashtra Rent Control Act, 1999.

In view of this, the second appeal is permitted to be withdraw with liberty to file either a revision or a writ petition, if so advised.

The second appeal is disposed of as withdrawn with liberty as aforesaid.
