On earlier occasion also, none had appeared for the Petitioner.

We have perused the record. The Petitioner was working as Section Officer in Panchayat Samiti, Amravati and retired on 31 August 2006. The Pensionary benefits were paid to the Petitioner on 4 October 2007. The Petitioner filed this Petition that his claim for interest on delayed payment of pension was rejected by the Respondent No.1- Chief Executive Officer, Zilla Parishad, Amravati by the impugned order.

Under the Maharashtra Civil Services (Pension) Rules, 1982, the claim for interest does not arise automatically on account of delay. In the present case, the Respondent No.1- Chief Executive Officer, on examination of the record, has found that the claim for interest was not justified for the grounds stated therein. Having received pensionary benefits in the year 2007 and what is sought is only an amount of interest, it appears that the Petitioner has lost interest in prosecuting the Petition, as none had appeared on two other occasions.
