None appeared for the applicant in the morning session. The matter was kept back. Again none appears for the applicant when the matter is called out in the afternoon session. Though the application is lacking in some of the required details, considering the fact that the delay is of 23 days only and the fact that the application is not opposed by the non-applicants inasmuch as reply is not filed by them, the delay is condoned. However, this is subject to the applicant depositing Rs. 500/- with the High Court Legal Services, Sub-Committee, Nagpur and producing the receipt of payment on the record of the First Appeal till 30th January, 2015. If the amount as directed above is not deposited and the receipt of payment is not produced on the record within the stipulated period, this order shall stand recalled and this application as well as the appeal shall stand dismissed without reference to the Court.
