Perused the affidavit. The reasons disclosed therein do not appear to be incorrect. Subject matter is an immovable property and we do not see any mala fides also. Mrs.B.H.Dangre, learned Government Pleader opposes any restoration.

In the Writ Petition, the orders of status quo were operating. In this situation, we re-call the order dt.22.1.2015 and restore the Writ Petition back to file. Civil Application No.412 of 2015 is accordingly allowed. Mrs.B.H.Dangre, learned Government Pleader waives service on behalf of the respondent on the Writ Petition after its restoration.

According to Mr.T.D.Mandlekar, learned Counsel for the petitioner/applicant, the matter is already covered. Mrs.B.H.Dangre, learned Government Pleader is seeking
