Heard Mr. Chaudhari, learned counsel for the petitioner. 2.

We are not satisfied with the reasons recorded in the impugned order by the respondent-Committee for the following reasons: (a) The documentary evidence produced by the petitioner is demonstrating that the petitioner is belonging to Bhoi community; (b) No adverse entries were collected by the Vigilance Cell and in such an eventuality the Committee ought to have accepted the documents which are produced by the petitioner; and (c) Though Vigilance Cell Inquiry was conducted, the affinity test was not applied to the case of the petitioner while rejecting the claim for validity.

That being so, the order impugned dated 14th January, 2019 is hereby quashed and set aside.

We permit the petitioner to appear before the respondentCommittee on 10th February, 2025.
