DATED : 03/02/2021 1] The accused has filed this application under Section 482 of the Code of Criminal Procedure contending that invoking the provisions of the Maharashtra Control Of Organised Crime Act against the applicant is unjustified and has prayed that the charge-sheet to that extent be quashed. 2] After examining the matter, we expressed that the grievance can be made before the trial Court when the applicant would be heard at the time of framing of the charge.

On this, learned advocate for the applicant, on instructions, sought permission to withdraw the criminal application with liberty to make the grievance before the trial Court.

3] The criminal application is dismissed as withdrawn with liberty as prayed for.
