Accepting the explanation given in the application and the submission made by the advocate for the applicant that the applicant will not claim interest for the period of 2499 days, the delay of 2499 days in filing the appeal is condoned.

The appellant shall file private paper book within six months.

There was delay of 2499 days in filing the appeal. While considering Civil Application No.2525 of 2017 filed by the appellant praying for condonation of delay, a submission was made on behalf of the appellant that the appellant will not claim interest and other statutory benefits for 2499 days. Accepting this submission made on behalf of the appellant, delay came to be condoned.

The advocate for the appellant and the A.G.P. shall point out the order passed on Civil Application No.2525 of 2017 at the time of hearing of the appeal. The learned advocate for the appellant and the learned A.G.P. submit that the matter can be placed before National Lok Adalat scheduled on 14th April, 2018. The parties/ representatives of the parties, shall remain present before the National Lok Adalat at Nagpur on 14th April, 2018 at 10.30 a.m.
