Leave is granted to amend the cause title of Civil application (CAO) Nos.1114/2024 and 1115/2024 so as to add legal representatives of deceased applicant No.1 in the above applications.

PUBLIC INTEREST LITIGATION NO. 36/2024 4.

Mr. N. S. Rao, learned Assistant Government Pleader appearing for respondent Nos.2 and 4 seeks time to file affidavit in reply.

In response to the Court's query, we are informed by the learned Counsel appearing for the

2 942.pil.36.24 petitioner, so also respondent Nos.1 and 3 Mr. Kunte that the order dated 23.08.2024 be corrected and it be observed that Mr. Kunte waives service of notice for respondent Nos.1 and 3 and Assistant Government Pleader waives service of notice for respondent Nos.2 and 4. 6.

We also direct the respondent No.3 to file affidavit-in-reply dealing with the issue involved in the petition.

We further direct the Executive Engineer, Public Works Department, who is executing the project in question, to remain present on the next date of hearing. 8.
