MARCH 3, 2025 The petitioner - original plaintiff had filed Corrected as per Court's order dated 18/3/2025 - in first line, replaced the word 'defendant' by 'plaintiff'.
application to produce additional documents, which was allowed. The petitioner had also prayed for verifying photocopies against the certified copies, which came to be rejected on the ground that no reason is assigned as to why has the petitioner not produced certified copies, which was in his possession, and why did he choose to file photocopies on record.
2] The learned Counsel for the petitioner submits that the certified copies were not filed because the petitioner intended to file proceedings before the Hon'ble Supreme Court, and for that purpose, the certified copies were withheld by him. This reason, however, has been not put forth in the application filed by the petitioner before the trial Court.
3] The learned Counsel for the petitioner submits that the purpose of filing the petition will be served if the petitioner is allowed to submit certified copies and thereafter to seek permission to get them back as and when required.
23-WP-1106-2025 corrected 4] The request being reasonable, the same is allowed. The petitioner may file application seeking permission to submit certified copies of the documents, which he intends to rely upon, which if filed, shall be considered by the trial Court on its own merits. If the petitioner in future intends to get back certified copies, he may file application, which again shall be considered by the trial Court on its own merits.
5] The petition is disposed of in above terms.
No costs.
